“There is a serious problem in the field of rights, justice and financial functions”
“Is the Constitution to blame us? What could the next review contribute? ” It was the title of the discussion of Professor of Constitutional Law, former Vice-President of the Government (2012-2015), Minister and former PASOK President Evangelos Venizelos With journalist Thanassis Lala at the Goulandris Foundation on Thursday night.
Ev. Venizelos referred to the constitutional revisions of the last 50 years, and noted the complexity of the revisions, in terms of their substance, given the “multiplicity of legal classes in the European environment” and the “superiority of Union law” on critical issues.
He stressed that what matters is the “national and social reconstitution” which is “something different from the constitutional review” for which he mentioned:
“Do we have internal prerequisites now for (constitutional) revision and consensus? We will go to the other House if we find the conditions for the country’s governance, that is, the formation of a government majority. Should we concern us if after the election of Trump we have the conditions for a serious debate on foreign policy that goes beyond the generalities that “we are fans of international law, Western country, pro -American, European, NATO”? They don’t mean anything. Do we have the conditions for a more serious discussion? We don’t have them. Do we have the prerequisites for a quality of power that concerns the way of the rule? No, I do not think we are discussing this seriously either with an autonomous or cooperative government, depending on what the Greek people will say. We have a social contract, do everyone feel that they are included somewhere after the financial crisis? What does “return to regularity” mean? “
“The big issue is the rule of law,” Ev. Venizelos, noting that “we are very good electoral democracy with election quality, the parliamentary system is working smoothly, everything worked fine and with autonomous governments and cooperation – with which we managed the financial crisis – but there is a serious problem in the field of rights and rights.”
He expressed his concern by saying, “The situation is dramatically evolving, public confidence in justice has been collapsed.”
He said that the debate “has been limited to the leadership of justice, the law on the responsibility of ministers and Article 16 on universities”.
He noted, inter alia, that “if there were innovations (in the law on ministerial responsibility) to take place in 2019. The Constitution was revised but the executive law was not amended, nor to date.”
Ev. Venizelos referred to the “conscious choices of public opinion”, his political and governmental career, while being asked about the proposal for “ministers of non -Members”, stressing that this “makes the prime minister even stronger, without such a move to be a guarantee.”
He said, among other things, that in Greece “the” sin of the world “is a political person because the real bodies of power are in the restless. We can have a long debate on parliamentary immunity or the responsibility of ministers, but it is acceptable that members of the Independent Authorities will not have criminal responsibility for the opinion they give in the exercise of their duties. That the administrations of banks and collection mechanisms will not have criminal responsibility for how they make decisions on so -called “red” loans. Because if you do not give them this immunity they do not take on, so everyone can sue them for infidelity or any other offense and drag them into the courts for years. “
“Do we want to modify Article 86 (on the responsibility of ministers)? Let everyone go with a simple lawsuit to the prosecutor. On the first day, on the first hour there will be about ten thousand lawsuits against the (any) prime minister, who will be handled by prosecutors in the country. It can be, let’s be done, let’s go “Mola-Iya I have”, we are going to rebuild the country under conditions of world uncertainty, “he added.
Asked about the country’s overall situation, he said that “in general we cannot place ourselves in relation to the level of institutional constitution and maturation of Europe.”
As he explained, “we believe that we are at the same time the best and the worst, that we are at the same time the” wealthy people “and a” bishop “and” this pendulum exterminates “.
“These are not resolved by a constitutional review, but we must be aware of the priority series as other things are preceded and the revision must be included in a comprehensive national reconstitution scheme where the national security system – all kinds of security – and the social contract are prioritized.” Venizelos.
