What does Article 74 of the House Regulation provide for
Announced in its plenary session Parliament The decision of the Court of Justice on the deduction of the three Spartan MPs Vassilis Stiga, Petros Dimitriadis and Alexandros Zervas from the parliamentary office.
At the same time, Parliament Vice President Yiannis Plakiotakis informed that the parliamentary group was dissolved. Spartan as it no longer has the necessary number of Members.
The House is now called upon to operate with 297 MPs, 8 parliamentary groups and 25 independent MPs.
Following the decision of the Court of Justice to deduct from the Parliamentary Axis of 3 MPs of the Spartans, including their President Vasilis Stiga, The House Bureau is in favor of maintaining the majority bar to 151.
What did Nikitas Kaklamanis say
“We rely on A.74 paragraph 2. All parties are in favor of 151, I feel that the government will also be 151,” Nikitas Kaklamanis told parliamentary authors, considering that the House of Representatives will not even need to be appealed. In favor of staying as the boundaries, in essence the Speaker of the House ended the scenarios for whether the reduction of the entire number of MPs to 297 lies up or down and the limits of the required majority.
Nikitas Kaklamanis President Nikitas Kaklamanis clarified that after a circle of contacts he had with opposition parties earlier in the morning and taking into account the positions of constitutionalists, as expressed in the public debate that opened yesterday, it seems that the view is prevalent.
What does the House Regulation provide for
According to the Rules of Procedure of the House, in a.74 (2) it states: “As for the Constitution or Conance requires the absolute majority of the entire number of the Bullers for the decision, this majority is submitted on the basis of the co -operators of the seats of the Body”. That is, even if the House operates with 297 MPs, 151 Members are required for approval:
Proposals for setting up a pre -trial committee, reference to ministers to the Judicial Council
Bills to change territory
According to this rationale, in the upcoming vote for the Tempi pre -trial establishment, the majority remains in 151 MPs.
In any case, where a simple majority of those present, the bar will fall to 149 Members. However, Nikitas Kaklamanis reserved for the purification and publication of the Supreme Court’s ruling on the Spartans seats, leaving open the possibility of seeking an opinion of the House Scientific Council, only if the decision explicitly states that the 297 MPs are 14.
But things do not seem to be as clear where a majority of 3/5, that is, 180 Members, as in the case of the Constitution’s revision. There, according to the Speaker of the House, the response to the majority will be given by the Constitution Committee.
However, Nikitas Kaklamanis appears willing to amend some articles in the House of Representatives that contradict the Constitution and are confusing. “It’s from the time of flour. Where we say “seats” to put “Members”, “the House Speaker said on the House Regulation by placing these changes in time before the debate on the revision of the Constitution was open.
