The same Court of Appeal, however, decided late on Tuesday night (28/10/2025) that it will review the case at an unspecified date, with an expanded composition, blocking the deployment of the National Guard.
“The Court of Appeal sends a clear message: the president can’t send the army into cities for no reason” commented Oregon Attorney General Dan Rayfield. Today, Wednesday, “we will go to the Court of First Instance to present our arguments so that this development can be stopped forever”, he added in a post on the X platform.
The judge of the Court of First Instance who had blocked the deployment of the army in the first phase, in early October, had scheduled a three-day hearing from today until Friday in order to issue a decision on the issue.
The courts have already halted the deployment of the National Guard and the Chicagoas requested by the city’s mayor and the Democratic governor of Illinois. THE Trump appealed on October 17 at Supreme Court, seeking its approval to continue this policy.
Since June, Trump has sent the National Guard to Los Angeles, Washington and Memphis, every time without the consent of the Democratic, local authorities.
