More powerful tools for Competition Commission brings the Ministry of Development’s bill for the establishment of the Independent Market Supervision and Consumer Protection Authority, which was put to consultation today (29.10.2025), predicting harshly fines for non-compliance with providing information and facilitating audits.
In particular, the Competition Commission will be able to impose fines of up to 1% of global turnover and additional daily penalties of up to 3% of the company’s average daily turnover until compliance, while targeted individual sanctions for executives are also introduced.
In information obligations, the enhanced provision covers not only outright refusal, but also embarrassment or delay in providing information, refusal of oral explanations and submission of inaccurate, misleading or incomplete answers.
For violations of this type, the company risks an administrative fine of up to 1% of the previous year’s turnover and, where necessary, an additional daily penalty of up to 3% of the average daily turnover until it complies. At the same time, individual liability is provided with fines from 15,000 to 2,000,000 euros for “any other” natural person who causes the violation (e.g. an external partner) and from 5,000 to 2,000,000 euros for employees or executives of the company. The “without prejudice to criminal sanctions” clause remains active for cases involving criminal law.
In the area of ​​investigations, the framework is toughened against practices that hinder or make difficult the work of the Commission’s ranks. Obstruction means, but is not limited to, denial of access to facilities or information systems, artificial delays in the delivery of records, alteration or destruction of data and changes in access rights that prevent the collection of evidence.
Here too, a corporate fine of up to 1% of global turnover is foreseen, plus a daily penalty of up to 3% of the average daily turnover from the date to be determined by the Authority’s relevant decision, until full compliance. A separate penalty of 15,000 to 30,000 euros per day of non-compliance is established for managers and employees, with the possibility of disciplinary action when public bodies are involved.
