Finally in a phenomenon of many years, where the debtors’ lists made public by the Independent Public Revenue Authority (AADE), were “loaded” with names of natural and legal persons recycled each year, wants to put a provision on management of the overdue debt.
The provision, contained in the bill on the new Customs Code in Consultation, aspires to radically change the way the arrears that cannot be collected is characterized, paving the way for AADE to clear a portfolio.
The arrangement does not change the basic law of the Code of Public Revenue Collection, but it brings significant administrative improvements as it tightens the criteria, accelerates procedures and expands the responsibilities of AADE bodies for the designation of debts as unpaid collection.
According to competent sources on newsit.gr, the aim is to substantially reduce the “dead” debts exceeding 26 billion euros, prioritizing the collection of the latest and realistic recoverable debts.
According to the provision, the new procedure evaluates the old debts in order of age, starting with the older ones.
The check is done on the basis of the debtor’s property. A debt can be classified as unacceptable collection, provided that the total value of real estate (and rights) does not exceed 5% of the debt and the limit of EUR 100,000, as evidenced by ENFIA. If the value exceeds EUR 100,000, then the debt is considered to be unpaid after the deduction of this value is deducted.
As far as the debtor’s mobile property is concerned, the total value of the mobile phones (deposits, vehicles, etc.) should not exceed EUR 30,000, as evidenced by an estimate or seizure report.
In the event that exceeds them, the removal of the double from the debt is again applied.
At the same time, there are special cases, such as debtors who have died without heirs or property, as well as businesses that have been bankrupt ten years ago, who can be directly integrated into the debt freezing process.
In addition, with the changes, the limits of competence are increasing: Heads of DOU and Customs can handle cases up to 300,000 euros, while larger amounts are required by the AADE Governor’s decision.
Of course, the framework is completed by the publication of large -scale debts with more than 150,000 euros (with the latter taking place a few days ago) and the prioritization of active cases. According to the same sources, the most efficient operation of the tax administration will also help increase the receipts, releasing AADE from the difficult management of old, “dead” debts.
