Change the rules for building in the countryside – who is the amendment of the RIS

In complete reform of the construction framework in the small settlements of the country is moving forward by the Ministry of Environment and Energy (RIS), attempting to solve an issue that has raised uncertainty for thousands of property owners.

With an amendment tabled in Parliament, the RIS re -establishes the terms of real estate for areas with a population of less than 2,000, following the annulment decisions of the Council of State that had abolished a significant portion of the previous regime.

The new framework provides for the separation of settlements into two categories, based on the population.

In the first category, which concerns settlements up to 700 inhabitantsessentially returns the old regime with certain modifications. Plots from 500 to 2,000 sq.m. They remain perfectly and buildable if they have a face of at least 10 meters on a communal road and keep at least 5 meters from it. However, to be considered to be considered to be considered for development, a specific justification for through urban planning study will be approved by a presidential decree.

In the second category, which includes the settlements from 701 to 2,000 inhabitantsstricter criteria are established. Here, the possibility of building outside the plan, but provided that the plot has a minimum area of ​​2,000 to 4,000 sq.m. and a person at least 15 meters on an approved road. This possibility is limited to cases where the plot is located in an area designated as “Special Uses Area” (PEX), with the final decision being taken following a reasoned crisis of the RIS.

It is also important to ensure the rights of owners on plots already have legitimate licenses or fall under presidential decrees setting boundaries of settlements – provided they meet the minimum facade and distances. Thus, it is attempted to safeguard the property of citizens who were in danger of seeing their real estates being discredited by urban planning.

The new institutional framework comes at a time when the ministry is called upon to balance between the need to respect the CoE decisions and the rural reality, where many settlements do not have modern planning plans. According to competent sources, the arrangements account for more than 90% of the country’s settlements below 2,000 inhabitants and are estimated to give a significant “breath” to owners and engineers, while facilitating the region’s development perspective.
